These Terms & Conditions establish the rules for using the JAINova Studio website and engaging JAINova Studio for services.

1. Website use. Visitors must use the website lawfully and must not attempt unauthorized access, introduce harmful code, submit false information, or misuse the site.

2. Submitting an inquiry. An inquiry does not automatically create a contract or client relationship. A formal project may require a separate agreement, proposal, statement of work, or invoice.

3. Communication. JAINova Studio may contact inquiry submitters through email, telephone, WhatsApp, or Viber using the information they provide.

4. Pricing. Services and starting prices shown on the website are for general information. Final pricing depends on the project's requirements and may be provided through a formal quotation or agreement.

5. Payments. Depending on the project, JAINova Studio may require a deposit, advance payment, milestone payments, or payment upon completion. The specific agreement controls the payment terms.

6. Intellectual property. JAINova Studio retains ownership of its pre-existing tools, templates, code, processes, designs, and other materials unless otherwise agreed. Ownership or licensing of a client's final deliverables is determined by the project agreement.

7. Music and AI services. Music projects should specifically define ownership, licensing, distribution rights, royalties, credits, and commercial use. AI-assisted projects may also be subject to the terms and licenses of third-party AI platforms.

8. Client-provided materials. Clients are responsible for ensuring they have the necessary rights to materials they provide to JAINova Studio.

9. Confidentiality. JAINova Studio will take reasonable steps to protect confidential client information. A separate NDA can be used when additional confidentiality protection is needed.

10. Employment matters. Providing services to clients does not automatically create an employer-employee relationship. Where JAINova Studio has employees or contractors, applicable Philippine laws and agreements govern those relationships.

11. Website availability. JAINova Studio makes reasonable efforts to keep the website operational but does not guarantee uninterrupted or error-free availability.

12. Third-party services. Services such as hosting, cloud storage, AI platforms, communications, and other external technologies may have their own terms and policies.

13. Liability. These Terms limit certain types of liability to the extent permitted by Philippine law while preserving liabilities that cannot legally be excluded.

14. Changes to the Terms. JAINova Studio can update the Terms when its services, technology, business practices, or applicable laws change.

15. Philippine law. The Terms are governed by the laws of the Republic of the Philippines, to the extent applicable.

This Privacy Policy explains how JAINova Studio collects, uses, protects, stores, and manages personal information submitted through the website.

1. Information collected. Name; email address; contact number; WhatsApp and Viber details; project/service requirements; notes and other information voluntarily submitted; and certain technical information such as IP address and device/browser information, depending on website configuration.

2. Purpose of collection. 5. Email, WhatsApp & Viber. JAINova Studio may use the contact details provided to communicate regarding an inquiry. Submitting an inquiry does not automatically enroll someone in an SMS marketing program.

6. Data sharing. JAINova Studio will not sell personal information. Information may be shared with authorized service providers when necessary to operate the website, provide services, process payments, communicate with clients, comply with the law, or protect the business.

7. Technology providers. Services such as Firebase, Google Cloud, GitHub, Cloudflare, email providers, WhatsApp, and Viber may be used. Actual providers may change as the business develops.

8. Data security. Reasonable organizational, physical, and technical safeguards will be used. No internet system can be guaranteed completely secure.

9. Data retention. Information will generally be retained only as long as reasonably necessary for inquiries, services, legitimate business records, legal requirements, dispute resolution, or legal claims.

10. Data-subject rights. Subject to applicable limitations, individuals may have rights to be informed, access their information, correct inaccurate information, object to certain processing, request erasure or blocking where applicable, exercise data portability where applicable, and file a complaint with the National Privacy Commission.

11. Privacy requests. Contact JAINova Studio to exercise applicable privacy rights. Identity verification may be required.
